Terms of Service

By creating an account or using the mCapital Brokerage app, website, or any related service (the “Services”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Services.

These Terms form a binding agreement between you and mCapital Global LLC and its licensed affiliates (together, “mCapital”, “we”, or “us”).

You must be at least 18 years old and legally able to enter into a binding contract to open an account. Certain products are available only to Non-Resident Bangladeshis or to residents of specific jurisdictions.

You are responsible for the accuracy of the information you provide during onboarding, including identity verification (KYC), source-of-funds, and any tax documentation such as a W-8BEN where applicable.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

mCapital provides self-directed trading in eligible securities, access to professionally managed funds, halal screening information, and related tools. Trading infrastructure is powered by third-party brokerage partners, including Alpaca.

Halal screening results, research, and any AI-generated insights are provided for information only. They are not a recommendation to buy, sell, or hold any security, and they are not a guarantee of Shariah compliance.

When you place an order, you authorize us and our brokerage partners to route and execute it. Prices shown in the app may be delayed and are not guaranteed until an order is filled.

We may decline, cancel, or delay orders where required by law, market conditions, risk controls, or the rules of an exchange or clearing house.

Applicable commissions, subscription fees for mCapital Plus, margin costs under our Musharakah Co-Invest structure, and other charges are disclosed in the app before you incur them. We may change fees with reasonable notice.

You agree not to use the Services for unlawful activity, market manipulation, money laundering, or to circumvent our screening, risk, or compliance controls. We may suspend or close accounts that breach these Terms.

The Services are provided “as is”. Investing involves risk, including the possible loss of principal. Past performance does not guarantee future results.

To the fullest extent permitted by law, mCapital is not liable for indirect, incidental, or consequential losses arising from your use of the Services.

We may update these Terms from time to time. Continued use of the Services after an update means you accept the revised Terms.
